I-140 vs. I-485: The two parts of the NIW process

By PetitionMatcher Research TeamPublished Updated

Key takeaways

  • An I-140 approval does not itself grant work authorization or permanent residence.
  • Concurrent filing requires visa availability and adjustment eligibility.
  • Check the USCIS filing chart, not only the DOS bulletin.
  • Applicants abroad generally use consular processing instead of I-485.

For EB-2 NIW applicants, Form I-140 establishes eligibility for the immigrant category and national interest waiver. Form I-485 is the separate application eligible people in the United States use to become permanent residents. I-140 approval alone does not grant a green card or work authorization. Can I file I-140 and I-485 together?

Sometimes. Eligible applicants may file both together when visa availability and the other adjustment requirements permit. This is called concurrent filing. Otherwise, you can pursue the I-140 petition while waiting to become eligible for I-485. USCIS concurrent-filing guidance.

How does the Visa Bulletin affect NIW applicants?

NIW applicants use the EB-2 category. Your priority date, generally the date USCIS properly received your NIW petition, determines your place in the visa queue. It is different from the petition approval date. Check your notice and any retained earlier priority date. USCIS I-140 instructions.

  • Final Action Dates: cutoffs relevant to visa availability for final approval.
  • Dates for Filing: cutoffs adjustment applicants may use only when USCIS permits that chart for their category and month.

Your priority date must be earlier than the applicable cutoff. A category marked Current (C) has no priority-date cutoff in that chart. Other eligibility requirements still apply. Check the DOS bulletin and USCIS chart selection together.

What if I am applying from abroad?

Applicants using consular processing pursue an immigrant visa through a U.S. embassy or consulate instead of filing I-485. Visa availability still matters. USAGov consular-processing overview.

Does NIW approval time equal time to a green card?

No. An I-140 processing time measures the petition stage. It does not include the separate wait for visa availability and adjustment or consular processing. PetitionMatcher keeps its NIW petition statistics separate from Visa Bulletin data.

Our case comparisons support research for the I-140 stage. See what our case data covers and the October 2026 EB-2 NIW cutoff analysis for the separate visa-availability picture.
